Can this be used over stained wood? We had new counter tops made of maple. We stained them and are looking for a good sealer that is food safe and that will also be a good waterproofer

No. The Penetrating oil must penetrate. If there's a stain on it, I'm assuming you stained with an oil based product, the penetrating stain cannot penetrate. If you used a water based stain, try any of our water based sealers, keeping in mind that none are Food Grade but all are non-toxic.
